These Terms of Service ("Terms") govern your use of TheHostlyAI's platform ("Service"). Please read them carefully. By using the Service on behalf of a hotel or hospitality business, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you ("you", "the hotel", or "account holder") agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to everyone who accesses the platform on behalf of a hotel or hospitality business.

2. Description of Service

TheHostlyAI is an AI operating channel for hotels. The Service provides an omnichannel inbox that centralizes guest communications across connected channels (such as web chat, Instagram, WhatsApp Business, Facebook and email), AI-assisted responses, and optional integration with hotel Property Management Systems (PMS). It helps hotel teams receive, organize and respond to guest messages and requests.

3. Hotel Authorization Responsibility

The hotel (account holder) is solely responsible for authorizing TheHostlyAI to act on its behalf on third-party platforms, including Meta (Instagram, Facebook), WhatsApp Business, Gmail and Outlook. By connecting a channel, you confirm that you have the authority to grant that access for the hotel. TheHostlyAI acts only within the scope of the permissions the hotel grants and is not liable for actions taken within that authorized scope. You are responsible for ensuring your use of connected accounts complies with the agreements you hold with those providers.

4. Third-Party Integrations

The Service integrates with third-party platforms, including Meta (Instagram, WhatsApp Business, Facebook), Gmail, Outlook, and hotel PMS systems. Your use of these integrations is also subject to the respective providers' own terms of service and platform policies. TheHostlyAI does not control, and is not responsible for, the policies, availability, or actions of these third-party platforms. If a provider changes or revokes access, related functionality may be affected.

5. Data Handling

All collection, use, retention, and deletion of personal and guest data is governed by our Privacy Policy, including GDPR-related details and data deletion requests. Please review the Privacy Policy for full information on how data is handled and your rights. These Terms do not duplicate that content.

6. Acceptable Use

You agree not to use the Service to:

7. Limitation of Liability

To the maximum extent permitted by law, TheHostlyAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service. The Service is provided "as is" and "as available", without warranties of any kind.

8. Changes to Terms

TheHostlyAI reserves the right to update or modify these Terms at any time. Changes become effective when posted on this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal and, where applicable, the European Union. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Portugal.

10. Account Termination

Either party may terminate the account at any time. Upon termination:

11. Subscription and Payment

Access to the Service is subject to a paid subscription plan. Pricing, billing cycles, and plan details are agreed upon at the time of contract.
